Why should I take this course?

This micro skills course from NHS Health Education England describes deprivation of liberty in health and care settings. It explains how to recognise deprivation of liberty, when to use the Deprivation of Liberty Safeguards (DoLS) to protect someone's rights, and when providers and commissioners must apply directly to the Court of Protection. It outlines the human rights protections that these legal frameworks provide for the person and for the provider and their staff. It explains the practice issues that have been identified with the existing frameworks, with a brief account of proposed legal changes. It discusses case law developments and how best to protect the human rights of people using services within current uncertainties.

Are the programs accredited for continuous professional development (CPD) or continuing medical education (CME)?

Our courses have been developed and are delivered by Talisium's global network of content providers including universities and various professional bodies whose work underpins CPD for healthcare professionals.

Certificates of completion will be available and can be downloaded once a course has been completed. These can be used as evidence of learning for training and CPD purposes. You will need to check with your governing body about CPD standards and requirements.

Unless otherwise stated, certificates issued through Talisium are not qualifications of any formal assessment.

Do I need any prior qualifications or experience?

Our courses and programs have been designed to meet the needs of a broad range of trainees and qualified healthcare professionals. For most courses, we do not ask that you hold certain qualifications or meet certain criteria.

Some courses are aligned to specialist medical curricula so there is a certain level of medical knowledge required in these cases. On the whole, however, the courses and programs are accessible to a broad audience of learners.

Explain the Supreme Court definition of deprivation of liberty

Know which legal frameworks apply in different settings, or for people of different ages

Recognise the human rights context of deprivation of liberty (HRA Article 5) and breaches of people’s rights under HRA Article 8, and know when to seek legal advice about their use

Explain how DoLS fit in to the wider MCA, in particular the statutory principles, and how restraint relates to deprivation of liberty

Describe the relationship between the statutory legal framework and case law, and explain the significance of the Ferreira case to hospital practice

Explain practical ways to avoid deprivation of liberty if possible, and to reduce its effect on the person is it is unavoidable

Describe the DoLS process as it relates to health and care practice, focusing on how it works to protect people’s rights and on responsibilities of providers within DoLS

Explain some key points about the forthcoming replacement of DoLS by the Liberty Protection Safeguards (LPS)

Accessible Style

We also provide a high contrast version of our e-learning sessions for users with vision disabilities. This style can be enabled and disabled by selecting this icon Use high contrast stylesheet in the footer of the session.

Selecting the high contrast style switches off many colour options, making most of the content black and white. Alternative versions of some content is also provided, for instance where it would otherwise be difficult for users with visual impairments or for those users not using a mouse device.

Safari (Mac OS X) - Select the Command (cmd or Apple) key and "+" (plus) to zoom in. Select the Command (cmd or Apple) key and "-" (minus) to zoom out.
Safari (iOS) - This is for Safari running on devices such as the iPad and iPhone. Place your index finder and thumb on the screen of the device, leaving only a small amount of space between and them. Keeping your fingers on the screen, move them apart slowly, increasing the space between them. As you move your fingers you will zoom into the page. To zoom out, do the opposite and move your index finger and thumb towards each other until they meet.

Access keys are intended to provide an alternative form of navigation by using keyboard shortcuts. Please note that only numeric keys have been used in this e-learning session, in an effort to provide the alternative navigtation while not conflicting with any other software that may use access keys or any access keys already defined by the user themselves.

Some assistive technology tools such as the IBM HomePage Reader and WindowEyes already make use of the alt+[access key] combinations. As such, users of these tools may not be able to use some of these access keys.
